Terms of Service — Foresight

Plain-English summary: Foresight is a beta product — use it for personal financial visibility, not as a substitute for professional financial advice. You own your data. We work hard to keep the service reliable, but can't guarantee perfection. Don't misuse the platform.

These Terms of Service ("Terms") govern your access to and use of the Foresight application and website at getforesight.app (the "Service"), operated by Foresight ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Beta Program

Foresight is currently in beta. The Service is provided for evaluation and feedback purposes during this period. As a beta participant, you acknowledge that:

The Service may contain bugs, errors, or incomplete features
Features may change, be removed, or be replaced at any time without prior notice
We may limit, suspend, or discontinue the Service at our discretion during the beta period
Beta access is provided free of charge; pricing will be introduced when the Service becomes generally available

Your participation in the beta program and any feedback you provide helps us improve Foresight. We may use your feedback without obligation to compensate you.

2. Eligibility and Accounts

You must be at least 18 years old to use Foresight. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@getforesight.app if you believe your account has been compromised.

You may not create more than one account without our written permission, or create an account on behalf of another person without their authorization.

3. Acceptable Use

You agree to use the Service only for lawful personal financial management purposes. You agree not to:

Use the Service for any commercial purpose or on behalf of a business without our written permission
Attempt to probe, scan, or test the vulnerability of the Service or breach any security measures
Scrape, crawl, or otherwise extract data from the Service by automated means
Reverse engineer, decompile, or attempt to access the source code of the Service
Interfere with or disrupt the integrity or performance of the Service
Upload malicious code, viruses, or harmful content
Impersonate another person or entity
Violate any applicable laws or regulations

4. Your Data

You retain full ownership of all financial data you enter into or upload to Foresight. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy of the financial information you enter. Foresight does not verify or validate the accuracy of data you provide.

You may request a copy of your data or deletion of your account at any time by contacting us. See our Privacy Policy for details.

5. Not Financial Advice

Foresight provides financial information and tools for personal use. Nothing in the Service constitutes financial, investment, tax, or legal advice. Always consult a qualified professional before making significant financial decisions.

The forecasts, projections, AI insights, and recommendations generated by Foresight are based on the data you provide and mathematical models. They are estimates only and should not be relied upon as guarantees of future financial outcomes. Actual results will vary based on factors outside the scope of the Service.

We are not a registered investment advisor, broker-dealer, financial planner, or tax professional. Use of the Service does not create a fiduciary relationship between you and Foresight.

6. Third-Party Services

Foresight uses third-party services to operate, including Supabase for data storage and authentication, and Anthropic's Claude API for AI features. Your use of Foresight is subject to these providers' terms and policies. We are not responsible for the practices of third-party services.

The Service may contain links to third-party websites. We do not endorse and are not responsible for the content or practices of any linked sites.

7. Intellectual Property

The Foresight name, logo, sunrise mark, and all software, designs, and content comprising the Service are owned by Foresight or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

Nothing in these Terms transfers any intellectual property rights to you beyond the limited license to use the Service for personal financial management as described herein.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. Given that Foresight is currently in beta, you should expect occasional downtime, data processing errors, and incomplete features.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORESIGHT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. DURING THE BETA PERIOD, WHEN THE SERVICE IS FREE, OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Foresight and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including disclaimers, limitation of liability, and indemnification — will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Cook County, Illinois.
